| Prop. 1A tightens up the process under which the state for the last several years has "borrowed" money from the Transportation Investment Fund, created by Prop 42 in 2002. Money from gas taxes was supposed to be transferred into this fund, and used solely for transportation purposes. | ||||
| However, past law allowed the Governor to declare a "severe state fiscal hardship", and the Legislature to agree, by 2/3 vote, to not do the payment transfer and instead use the money for other purposes. | ||||
| Prop 1A does not prevent this. It does, however, add an additional requirement to these two, that the Legislature must commit by law to restore the suspended payment within 3 years of its having been suspended. | ||||
| It also says that the payment may not be suspended more than twice in a ten year period, and may not be suspended if a previous suspension has not been repaid. | ||||
| Payments suspended in years prior to 2007 are considered to be owed to the Transportation Investment Fund, and must be entirely repaid by no later than June 30, 2016. No less than 1/10 of the entire amount due to be repaid must be paid each year. | ||||
